These Terms and Conditions of Sale (T&Cs) are concluded between Clémence COLLIOU KHAN, hereinafter referred to as "The Kinesiologist," and any person wishing to benefit from her services, hereinafter referred to as "The Client."
Clémence COLLIOU KHAN operates as a sole proprietorship, registered under the SIREN number 942299967, with the registered office located at 15 rue Manin, 75019 Paris, France. She is covered by professional liability insurance with XXXX.
The Kinesiologist is not subject to VAT, as per Article 293B of the French General Tax Code (CGI).

Article 1 – Pre-contractual information
These general terms and conditions are provided to the Client, who acknowledges having received them. The following information is clearly and understandably communicated to the Client:

The price of the service or the pricing method, and if applicable, any additional costs for transport, delivery, or postage, and any other potential fees

The date or timeframe within which the service provider agrees to execute the service, regardless of its price, and any other contractual conditions

Information regarding the identity of the service provider, their postal, phone, and electronic contact details, and their activities

The procedures for handling complaints
The Kinesiologist and the Client agree that these terms and conditions exclusively govern their relationship. The Kinesiologist reserves the right to modify these terms occasionally. They will apply as soon as they are made available online.
If any clause in these T&Cs is deemed invalid, this does not invalidate the remaining clauses, which will still be enforceable.
Article 2 – Definition of the activity and services offered
The Kinesiologist practices kinesiology, a psychophysical technique designed to help individuals achieve improved well-being on mental, emotional, and physical levels. Through precise muscle testing, the kinesiologist communicates with the Client's body to identify the source of stress and blockages and release associated tensions. Generally, a muscle in the arm is used for comfort, though other muscles may be engaged if necessary.
Each kinesiology session is unique as it adapts to the specific needs of the Client’s body. The Kinesiologist works with the individual to help them achieve their set goals, requiring motivation, involvement, and active participation throughout the session.
A session lasts between 1h15 and 1h30 for an adult and 1h for a child. It may take place standing, sitting, or lying down, depending on the technique used. The person remains fully clothed during the session, removing only shoes and metal objects.
Article 3 – Payment terms
Kinesiology sessions must be paid for in cash at the end of each session. Payment by bank transfer is also possible, but the total amount must be received by the company 24 hours before the scheduled session.
An invoice will be sent by email upon the Client's request. The pricing for a kinesiology session is €80 for an adult and €70 for children. The prices are quoted in Euros excluding VAT (VAT not applicable, Article 293B of the CGI). These rates are those in effect at the time of booking.
Article 4 – Obligations of the kinesiologist and the client
The Kinesiologist commits to providing personalized kinesiology sessions with respect to the Client, regardless of their condition, age, or beliefs. However, she cannot be held responsible for any statements or events discussed during the session.
The Kinesiologist commits to:

Adhering to the Kinesiologists' Code of Ethics
Kinesiology cannot replace medical treatment. Any health issues must first be examined by a doctor. The advice, recommendations, and services offered by Clémence COLLIOU KHAN are not substitutes for medical opinions. The Client must consult their doctor or medical specialist before discontinuing or altering any medical treatment.
The Kinesiologist is not obligated to deliver a specific outcome.
Article 5 – Obligations of the client
It is the Client's responsibility to verify all necessary information before booking any services with Clémence COLLIOU KHAN. After an initial session, the Client decides whether to schedule another appointment based on their needs and expectations.
The Client agrees to notify the Kinesiologist at least 2 working days (48 hours) in advance for any cancellations or rescheduling. After this period, any canceled or unconfirmed sessions will be charged in full. Cancellations must be made by phone or via the Resalib platform.
In case of no-show appointments without prior notice, the Kinesiologist reserves the right to refuse future appointments upon request.
Article 6 – Confidentiality and data protection
Personal information collected during consultations remains confidential and is subject to professional secrecy based on the nature of the services provided.
The Client's personal data will be collected and processed confidentially, in compliance with the French Data Protection Law of January 6, 1978, as amended, and the General Data Protection Regulation (GDPR) effective from May 25, 2018.
The Client is reminded that the personal data requested is necessary for creating their consultation file. This data is for internal use only. The Kinesiologist is responsible for data protection.
The Client has the right to access, modify, rectify, and object to the processing of their personal data by making a direct request via email to Clémence COLLIOU KHAN at clemence.colliou@gmail.com.
Article 7 – Inability to work
In case of temporary physical incapacity due to illness or accident, the Kinesiologist reserves the right to reschedule future sessions in consultation with the Client, without the Client being entitled to any compensation.
In the event of permanent physical incapacity of the Kinesiologist, any ongoing engagement with the Client will be automatically terminated without any compensatory indemnity.
Article 8 – Language of the contract
These terms and conditions are written in French. In the event that they are translated into one or more foreign languages, the French text will prevail in case of dispute.
Article 9 – Governing law
These terms and conditions are governed by French law, both in terms of substance and form.
Article 10 – Complaints
Any complaints, whether amicable or legal, regarding the execution of services must be made within one year from the completion of the service.
